Terms of Service
These Terms of Service ("Terms") govern your use of WhoDial, a reverse phone lookup service operated by Remington Hawk, a sole proprietor based in Florida ("WhoDial," "we," "us," or "our"). By accessing or using WhoDial's website or API (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.
1. What the Service Does
WhoDial returns publicly and commercially sourced information about a phone number, limited to: carrier, line type, prepaid status, and registered name where available. Results are provided by third-party data and telecommunications providers and are not independently verified by WhoDial.
2. This Is Not a Consumer Report
WhoDial is not a "consumer reporting agency" and does not furnish "consumer reports" as those terms are defined under the U.S. Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.
You may not use any information obtained through the Service, in whole or in part, as a factor in determining eligibility for:
- Credit or insurance underwriting;
- Employment (hiring, promotion, or termination decisions);
- Housing or tenant screening;
- Any other purpose that would classify the information as a "consumer report" under the FCRA.
The Service does not conduct background checks and results should not be relied on as a substitute for one. Using the Service for any FCRA-regulated purpose is a violation of these Terms and may violate federal law. You are solely responsible for how you use information obtained through the Service.
3. Accounts and Billing
Some features require an account and a paid subscription, billed through Stripe. Subscriptions renew automatically until canceled. You can manage or cancel your subscription at any time through the billing portal linked in your account.
4. Refunds
Refunds are available within 7 days of any charge (initial purchase or renewal), prorated based on lookups used during that billing period. Requests outside this window, or for prior billing periods, are not eligible. Request a refund by contacting support@whodial.app.
5. Acceptable Use
You agree not to:
- Use the Service to stalk, harass, or locate a person without their consent;
- Scrape, bulk-extract, or automate lookups outside the documented API and its rate limits;
- Resell, sublicense, or redistribute lookup results as a standalone data product;
- Attempt to circumvent rate limiting, authentication, or paywall gating.
We may suspend or terminate accounts that violate this section without notice.
6. Data Accuracy Disclaimer
Phone number data (carrier, line type, prepaid status, name) changes frequently and is sourced from third parties. WhoDial makes no guarantee that results are current, complete, or accurate, and disclaims liability for decisions made in reliance on them.
7. Intellectual Property
The WhoDial name, logo, and site design are the property of WhoDial. Nothing in these Terms grants you rights to our branding except as needed to use the Service normally.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, WhoDial will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 3 months preceding the claim.
10. Indemnification
You agree to indemnify and hold WhoDial harmless from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms, including any FCRA-regulated use prohibited under Section 2.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service and cancel your subscription at any time.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Florida.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect.
